1. Agreement to Terms
These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“Agent”, “you”), and STAYZA PRO LTD (“we,” “us,” or “our”), concerning your access to and use of the STAYZA PRO platform as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto.
2. Service Description
STAYZA PRO is a specialized short-let management infrastructure platform designed for property managers operating in the Federal Republic of Nigeria. Our services facilitate booking management, payment processing, identity verification, and calendar synchronization for short-term rental properties.
3. Account Registration & Eligibility
To access the core features of the platform, you must register for an Agent account. You represent and warrant that you are at least 18 years of age and hold a legally registered business entity within Nigeria. You agree to provide true, accurate, current, and complete information during the registration process.
4. Agent Obligations
Agents are strictly responsible for maintaining the accuracy of their property listings. This includes up-to-date availability calendars, transparent pricing without hidden fees, and honest representation of the property conditions. Agents must comply with all local safety regulations and ensure proper guest safety measures are in place.
5. Guest Obligations
While you manage the guests, our terms extend to guest behavior processed through our booking engine. Guests are required to provide accurate government-issued identification. Subletting or transferring bookings without explicit Agent consent is prohibited.
6. Commission & Payment Terms
We charge a flat 5% commission strictly on the room fees for each booking processed through the platform. By default, the remaining funds are split 50/50 between the property manager and the property owner, unless custom splits are configured. All payments are processed securely via Paystack, with automated payouts initiated within 24–48 hours following guest checkout.
7. Cancellation & Refund Policy
Our standard cancellation tiers apply unless overridden by specific property rules: Cancellations made 7 or more days prior to check-in receive a full refund. Cancellations made 3–6 days prior receive a 50% refund. Cancellations made less than 72 hours before check-in are strictly non-refundable.
8. Dispute Resolution
In the event of a dispute, parties agree to first attempt resolution through our internal mediation process. If unresolved within 30 days, the dispute shall be submitted to binding arbitration in Lagos State, Nigeria, in accordance with the Arbitration and Conciliation Act.
9. Intellectual Property
STAYZA PRO LTD retains all ownership rights to the platform infrastructure, code, and design. Agents retain full ownership of the intellectual property rights to their respective listing content, including property images and descriptions.
10. Limitation of Liability
To the maximum extent permitted by law, STAYZA PRO LTD's total liability for any claims arising out of or relating to these Terms or the platform shall not exceed three (3) times the total commission earned by us from your transactions in the month preceding the claim.
11. Termination
Agents may terminate their account with a 30-day written notice. We reserve the right to suspend or terminate accounts immediately and without prior notice for violations of these Terms, suspected fraud, or legally mandated compliance.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, subject to the exclusive jurisdiction of the courts located in Lagos State.
